II. Users

Access to and/or use of the S2E Energy Portal grants the status of user (hereinafter, the “User”), who fully accepts, from the moment of access and/or use, the General Conditions of Use reflected here.

III. Use of the Portal

The S2E Energy Portal provides access to a multitude of information, programs, or data (hereinafter, the “Services”) on the Internet belonging to S2E Energy or its licensors to which the User may have access.

The provision of Services by S2E Energy is free of charge for Users.

The User assumes the responsibility for the use of the Portal, which extends to the registration or completion of forms required to access certain services or content. In any case, registration will be carried out in the manner expressly indicated in the service itself, with the User responsible for providing truthful and lawful information and keeping the information provided updated at all times.

As a consequence of this registration, the User may be provided with a password for which they will be responsible, committing to use it diligently and confidentially.

The User will be solely responsible for any false or inaccurate statements they make and for any damages caused to S2E Energy or third parties due to the information they provide.

The User also agrees to make appropriate use of the Website and its Services, without violating the provisions of this Legal Notice, prohibiting the following:

Engaging in illegal, unlawful activities or contrary to public order.
Disseminating content or propaganda of a racist, xenophobic, pornographic- illegal nature, glorifying terrorism, or infringing upon human rights.
Causing damage to the physical and logical systems of S2E Energy, its suppliers, or third parties, introducing or disseminating computer viruses or any other physical or logical systems that could cause the aforementioned damage.
Attempting to access and, if applicable, use the email accounts of other Users and modify or manipulate their messages.

S2E Energy reserves the right to remove any comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, harmful to youth or childhood, public order or safety, or that, in its opinion, are not suitable for publication. In any case, S2E Energy will not be responsible for the opinions expressed by Users through forums, chats, or other participation tools.

Regarding content (information, photographs, design, text, sound files, image files), the following is prohibited:

Reproducing, copying, distributing, disseminating, transforming, or modifying, and publicly communicating them unless authorized by the legitimate holder or permitted legally.
Violating the rights of S2E Energy or its legitimate holders over them.
Using them for any commercial or advertising purposes other than those allowed.
Attempting to obtain the content of the Portal by any means other than those made available to users, as well as those commonly used on the network.

IV. Personal Data Protection – Privacy Policy of S2E Energy

S2E Energy complies with the guidelines of Organic Law 15/1999 of December 13 on Personal Data Protection, Royal Decree 1720/2007 of December 21 approving the Regulation for the development of the Organic Law, and other applicable regulations at all times, ensuring the proper use and treatment of the user’s personal data.

S2E Energy may collect, in each form required for access to certain Services or content, personal data for storage and/or use concerning the User. Automatically, a file will be created owned by Villatin de Inversiones SL (hereinafter, the “File Controller”) with an address at C/ Puerto Rico 12 P4, 1°B – 07007 Palma de Mallorca , Spain, or the Group Company of Villatin de Inversiones SL in question, and the User will be informed of the file’s responsibility, the address of the responsible party, the possibility of exercising their rights of access, rectification, cancellation, or opposition, the purpose of the processing, communications to third parties (if any), the mandatory or optional nature of the responses, the consequences of refusing to provide them, and, in general, all mentions required by applicable legislation on personal data protection.

The File Controller commits to treating the data provided by the User in accordance with applicable regulations.

V. Intellectual and Industrial Property

S2E Energy, either directly or as an assignee, is the owner of all intellectual and industrial property rights of its website, as well as the elements contained in it (including, but not limited to, images, sound, audio, video, software, or texts; trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its functioning, access, and use, etc.), owned by S2E Energy or its licensors.

All rights reserved. Under the provisions of Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution, and public communication, including its availability, of all or part of the contents of this website for commercial purposes, in any medium and by any technical means, is expressly prohibited without the authorization of S2E Energy. The User agrees to respect the intellectual and industrial property rights owned by S2E Energy. They may view the elements of the Portal and even print, copy, and store them on their computer’s hard drive or any other physical medium, provided it is solely for their personal and private use. The User must refrain from deleting, altering, circumventing, or manipulating any protection device or security system that may be installed on the pages of S2E Energy.

VI. Exclusion of Guarantees and Liability

Under no circumstances will S2E Energy grant guarantees or be liable for damages of any nature that may arise, including but not limited to:

Errors or omissions in the contents and/or services.
Lack of availability and effective functioning of the Portal and/or its Services and contents.
The presence or transmission of viruses or malicious programs despite having configured all technological measures to avoid it.
The opinions of users in forums, chats, and messages in the various areas of the Portal.
The unlawful, negligent, fraudulent use, contrary to these General Conditions, to good faith, to generally accepted uses, or to public order of the Portal, its Services, or contents by the users.

VII. Modifications

S2E Energy may, without prior notice, and whenever it deems appropriate, unilaterally modify the structure and design of the Portal as well as its conditions of access and/or use. It may also modify, delete, or add contents and Services provided through it, as well as the way in which they are presented or located on the Portal.

VIII. Links

The S2E Energy Portal may contain links or hyperlinks to other websites controlled and managed by third parties.

S2E Energy does not exercise any type of control, nor does it market or adopt the contents, services, information, and statements available on such websites. Additionally, the inclusion of these external connections does not imply any type of association, merger, or participation with the connected entities.

Under no circumstances will S2E Energy assume any responsibility, even indirectly or subsidiarily, for the contents of any link belonging to an external website, and/or for damages of any kind that may arise from access to them. There is also no guarantee of the technical availability, reliability, quality, accuracy, breadth, truthfulness, validity, and constitutionality of any material or information contained in any of these hyperlinks or other websites.

IX. Right of Exclusion

S2E Energy reserves the right to deny or withdraw access to the Portal and/or the Services offered without prior notice, at its own request or that of a third party, to those users who violate these General Conditions of use.

X. General Provisions

S2E Energy will pursue the breach of these Conditions as well as any improper use of its Portal by exercising all civil and criminal actions that may correspond to it by law.

XI. Modification of these General Conditions

S2E Energy may modify these stipulated conditions at any time, being duly published as presented here. The validity of these conditions will be in accordance with their exposure and will remain in effect until they are modified by other duly published conditions.

XII. Duration

The service provision of the website, as well as the services it offers, will have an indefinite duration. However, S2E Energy reserves the right to interrupt, suspend, or terminate the provision of the Portal service or any of the services and/or contents that comprise it.

XIII. Applicable Legislation and Jurisdiction

The relationship between S2E Energy and the User will be governed by current Spanish legislation, and any controversy, conflict, or dispute that arises will be resolved by the Arbitration Court of the “Confederación de Asociaciones Empresariales de Baleares”.
